3. Liquidated Damages for Unauthorized Access and Hacking

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

Any unauthorized access, hacking attempt, security breach, or violation of these Terms of Use constitutes a material breach and causes immediate, irreparable harm to Loma Cotta.

LIQUIDATED DAMAGES: In the event of any unauthorized access, hacking, security breach, or prohibited activity as defined in Section 2, you agree to pay Loma Cotta liquidated damages in the amount of $10,000.00 USD per event, which represents a reasonable estimate of the damages incurred, including but not limited to:

• Investigation and forensic analysis costs
• System remediation and security enhancement expenses
• Business interruption and lost revenue
• Legal and professional fees
• Reputational damage
• Notification and compliance costs

This liquidated damages provision applies to each separate event of unauthorized access or prohibited activity. Multiple violations may result in multiple liquidated damages assessments.

4. Additional Remedies

Liquidated damages do not limit Loma Cotta's right to seek:

• Injunctive relief and equitable remedies
• Actual damages in excess of liquidated damages if proven
• Attorneys' fees and costs
• Criminal prosecution where applicable
• Any other remedies available under law

5. Intellectual Property

All content, trademarks, logos, software, and materials on this website are the exclusive property of Loma Cotta and are protected by copyright, trademark, and other intellectual property laws. Unauthorized use is strictly prohibited.

6. Service Availability

Loma Cotta reserves the right to modify, suspend, or discontinue any aspect of our services at any time without notice. We do not guarantee uninterrupted or error-free service.

7. Limitation of Liability
